Terms and Conditions for Staffing Request

These Terms and Conditions ("Terms") govern the use of services provided by Staffing Request, a childcare staffing agency ("Agency," "we," "us," or "our"), to clients and candidates ("you" or "your"). By using our services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please refrain from using our services.
1. Services Provided
Staffing Request provides staffing solutions for childcare providers, including the recruitment, placement, and management of childcare professionals. We connect qualified childcare professionals ("Staff") with Child Care Centers("Clients") in need of childcare staffing services.
2. Client Responsibilities
As a Client, you agree to:
Provide accurate and complete information regarding your childcare staffing needs and preferences.
Ensure a safe and compliant working environment for the Staff.
Pay all agreed-upon fees for services promptly and in accordance with our billing terms.
Comply with all applicable state, local, and federal laws regarding employment, child safety, and childcare practices.
3. Staff Responsibilities
As a Staff member, you agree to:
Maintain the necessary qualifications, certifications, and background checks required for your role as a childcare professional.
Provide quality childcare services and adhere to all applicable safety standards and regulations.
Communicate promptly and professionally with Staffing Request and Clients regarding scheduling, availability, and any issues that may arise during your placement.
4. Fees and Payment
The Agency charges a fee for staffing services based on the specific needs and requirements of the Client. This may include hourly, weekly, or fixed-fee arrangements.
Payments are due upon invoicing unless otherwise agreed upon. Late payments may incur additional charges.
All fees are exclusive of taxes, which are the responsibility of the Client.
5. Background Checks and Compliance
All Staff placed by Staffing Request undergo background checks as required by state and federal law, including but not limited to criminal history, child abuse clearances, and other relevant checks in Pennsylvania.
Clients and Staff agree to allow background checks and verification of references as part of the hiring process.
6. Termination of Services
Either the Client or the Agency may terminate the services at any time with written notice. Upon termination, the Client is responsible for paying for all services rendered up to the termination date.
If a Staff member is terminated by a Client, the Client must inform the Agency immediately to ensure appropriate action is taken.
7. Liability and Indemnification
Staffing Request will not be liable for any injuries, damages, or losses incurred by the Client, Staff, or any third party during the provision of childcare services.
Clients agree to indemnify and hold harmless Staffing Request, its employees, and agents from any claims, damages, or losses arising out of or in connection with the services provided.
8. Confidentiality
Both the Client and the Staff agree to maintain the confidentiality of all personal, financial, and sensitive information shared during the course of the relationship.
9. Compliance with Pennsylvania Law
Both the Client and the Agency agree to comply with all applicable state and local laws in Pennsylvania, including those related to employment, child protection, and safety.
The Agency is registered with the appropriate Pennsylvania state authorities and complies with all licensing requirements.
10. Modifications to Terms
Staffing Request reserves the right to modify or update these Terms at any time. Any changes will be communicated to Clients and Staff, and the updated Terms will be posted on our website or provided upon request. By continuing to use our services after modifications, you agree to be bound by the updated Terms.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any disputes arising out of or in connection with these Terms will be resolved through binding arbitration in Pennsylvania.
